By accessing or using Marketplace Marketplace ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

2. Age Requirement

You must be at least 21 years of age to use this Service. By using the Service, you represent and warrant that you are at least 21 years old and that you have the legal capacity to enter into this agreement.

3. Account Registration

To access certain features, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your password
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

4. Marketplace Services

For Customers

• Browse and purchase products from verified vendors
• Products are subject to availability and vendor terms
• Prices include applicable taxes unless otherwise stated
• Delivery is available in select areas only

For Vendors

• Must provide accurate product information and descriptions
• Responsible for fulfilling orders in a timely manner
• Must comply with all applicable laws and regulations
• Subject to marketplace commission fees (typically 15%)

5. Prohibited Products and Activities

The following are strictly prohibited:

• Sale of products to individuals under 21 years of age
• Counterfeit or unauthorized products
• Products that violate any laws or regulations
• Misleading or false product descriptions
• Harassment or abuse of other users
• Attempting to circumvent the platform for direct sales

6. Payment Terms

• All payments are processed securely through Stripe
• Prices are in USD unless otherwise specified
• You authorize us to charge your payment method for all purchases
• Refunds are subject to vendor policies and our refund policy

7. Delivery and Fulfillment

• Delivery services provided through DoorDash Drive
• Delivery times are estimates and not guaranteed
• Signature required for all deliveries
• Valid ID required to confirm age upon delivery
• Failed delivery attempts may incur additional fees

8. Intellectual Property

All content on the Service, including text, graphics, logos, and software, is the property of Marketplace or its licensors and is protected by copyright and other intellectual property laws. You may not use, reproduce, or distribute any content without our written permission.

9. User Content

By posting content on our Service, you:

• Grant us a non-exclusive, worldwide license to use your content
• Represent that you own or have rights to the content
• Agree that your content does not violate any laws or rights

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE CONTINUOUS, UNINTERRUPTED, OR SECURE ACCESS TO THE SERVICE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DASH STACHE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

12. Indemnification

You agree to indemnify and hold Marketplace harmless from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

13. Dispute Resolution

Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in Columbus, Ohio.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law provisions.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

16. Termination

We may terminate or suspend your account at any time for violation of these Terms. Upon termination, your right to use the Service will immediately cease.
